The California Supreme Court has found that no one can show just cause as to why a same-sex couple cannot be legally joined together.

So, the court declared. So I wish the Christian right would forever hold its peace.

California Supreme Court Chief Justice Ronald George wrote last week's historic 4-3 majority ruling clearing the way for legal same-sex marriage in the state. "In contrast to earlier times, our state now recognizes that an individual's capacity to establish a loving and long-term committed relationship with another person and responsibly to care for and raise children does not depend upon the individual's sexual orientation, and, more generally, that an individual's sexual orientation - like a person's race or gender - does not constitute a legitimate basis upon which to deny or withhold legal rights," George wrote. "We therefore conclude that in view of the substance and significance of the fundamental constitutional right to form a family relationship, the California Constitution properly must be interpreted to guarantee this basic civil right to all Californians, whether Gay or heterosexual, and to same-sex couples as well as to opposite-sex couples."

There were a number of attorneys involved in fighting for marriage rights in California when taking into account the amicus briefs filed on behalf of about 250 groups. Shannon Price Minter, legal director of the National Center for Lesbian Rights, argued the case on behalf of 14 same-sex couples, two organizations, Equality California and Our Family Coalition, and the tradition of a cherished commitment. Lambda Legal, the American Civil Liberties Union, Heller Ehrman LLP, the Law Office of David C. Codell and San Francisco City Attorney Dennis Herrera also played crucial legal eagle roles.

Fourteen couples sued for the freedom to marry, including two of the nation's most esteemed GLBT rights activists, Phyllis Lyon and Del Martin, partners of 56 years. "We are thrilled that this day has finally come," Lyon said in a statement after learning of the court's decision.

The other couples in the case included Arthur Frederick Adams and Devin Wayne Baker, Alexsis Beach and Rachel Lederman, Myra Beals and Ida Matson, Dave and Jeff Chandler, Sarah and Gillian Conner-Smith, Corey Davis and Andre LeJeune, Stuart Gaffney and John Lewis, Jewelle Gomez and Diane Sabin, Margot McShane and Alexandra D'Amario, Jeanne Rizzo and Pali Cooper, Joshua Rymer and Timothy Frazer, Karen Shain and Jody Sokolower and Janet Wallace and Deborah Hart.

In 2004, Gavin Newsom inspired a movement as the newly elected mayor of a city that had inspired the Gay rights movement some 25 years earlier. From the home of the late Harvey Milk, Newsom ordered the city to issue marriage licenses to same-sex couples. Thousands gathered at city hall over the next four weeks. And across the country, Gays and Lesbians who had grown up cynical about obtaining the American dream dared to rethink their opportunities.

So the governor is standing for what he believes in and has vowed to fight any initiative intended to rollback marriage freedoms in California. "I will always be there to fight against that. It will never happen," he has said.
