A McChord Air Force Base flight nurse discharged under the Department of Defense "don't ask, don't tell" policy will have her day in court -- more than a year from now.

Then a 19-year veteran of the service, Air Force Maj. Margaret Witt was notified in March 2006 that she would be discharged from the service because she was a homosexual. Since then, the decorated flight nurse has been fighting her dismissal in federal court.

Following a brief hearing in U.S. District Court in Seattle on Wednesday, Witt and her attorneys received a September 2010 trial date. Between then and now, attorney James Lobsenz said, they'll wait to see if the Obama administration comes through on a pledge to dismantle restrictions on gays and lesbians serving in the military.
