PROP 8 TRIAL UPDATE: Testimony in Gay trial wraps up

by Shaun Knittel - SGN Staff Writer

The Proposition 8 trial, Perry v. Schwarzenegger, the federal case challenging California's ban on same-sex marriage, ended on January 27. The trial provided an unprecedented glimpse into the social conflict over whether Gay and Lesbian couples have the right to marry, and served as the first stage of a prolonged legal battle that all sides insist is destined for the U.S. Supreme Court.

Not surprisingly, both foes and supporters of Proposition 8 came away convinced they had won. However, there are still a few loose ends in the case before Chief U.S. District Judge Vaughan Walker decides the legality of Proposition 8, which was approved by voters in 2008. The two sides have a month to file legal briefs.

Walker, who will decide the case without a jury, said he will set a date for closing arguments after reviewing the evidence. Walker is expected to take several weeks to review the evidence in the case before hearing closing arguments, which are expected sometime in March.
