L.A. City Council passes condom ordinance

On January 10, the Los Angeles City Council passed an ordinance requiring performers in the city's porn industry to use condoms during filming.

The vote was 11-1 in favor.

The measure requires a second, final approval to become law, with only eight votes needed at that time. The law would then go into effect in 90 days.

The City Council's action preempted a proposed city-wide initiative that asked voters to approve the condom requirement.

The AIDS Healthcare Foundation organized the city initiative and a second county-wide initiative campaign that began gathering signatures this month.

'In a historic move, during today's City Council meeting, the Los Angeles City Council adopted the proposed ordinance, 'City of Los Angeles Safer Sex in the Adult Film Industry Act,' a ballot initiative that has recently qualified to be placed on the June 5, 2012 election [ballot],' AIDS Healthcare Foundation said in a statement.

The original city initiative, which was slated for a June vote, was blocked by a suit brought by Los Angeles City Attorney Carmen Trutanich.

Trutanich claimed that the state of California, and not the city, has jurisdiction over occupational health and safety issues.

The AIDS Healthcare Foundation responded to her suit with a Los Angeles County initiative campaign on the grounds that counties have jurisdiction over public health issues.

The proposed legislation stemmed from a several cases in which adult film performers tested HIV-positive after having unprotected sex on porn shoots. The most recent case involved Derrick Burts, whose HIV-positive diagnosis in October 2010 caused a temporary shutdown of the porn industry.

Burts told authorities that he had unprotected sex with six men and 10 women in the two months before his HIV diagnosis.
