The Social Security Administration has published new rules that treat same-sex spouses the same as opposite-sex spouses when processing applications for SSI (Supplemental Security Income).

The agency says that these new instructions come in response to last year's Supreme Court decision in USA v. Windsor, which found Section 3 of DOMA unconstitutional.

'As with previous same-sex marriage policies, we worked closely with the Department of Justice,' said Acting Commissioner of Social Security Carolyn W. Colvin. 'With the release of these instructions, we continue our commitment to treating all Americans fairly, with dignity and respect.'

SSI provides monthly stipends to low-income residents of the United States who are either 65 or older, blind, or disabled. While the program is administered by the Social Security Administration, money for the program comes from general tax revenues and not from the Social Security Trust Fund.

The program was established in 1974, and today provides monthly benefits to about eight million U.S. residents.

SSI benefit levels were initially pegged to the average monthly benefit that a retired worker got under the Social Security retirement benefits program, and SSI benefits automatically increase by the same percentage and at the same time as Social Security retirement, survivors, and disability benefits.

However, the benefit payable to a couple is smaller than the combined benefits payable to two individuals, because Congress believed that two people living together can live more economically than if each lived alone. The reduced SSI couple benefit applies only to those who are legally married, which now includes Gay and Lesbian spouses.

Critics say that these rules give SSI beneficiaries an incentive not to marry. On the other hand, SSI benefits are not restricted to U.S. citizens, so non-citizen spouses - now including same-sex spouses - of U.S. citizens may be eligible for SSI benefits.

The rules governing non-citizens are complex, however, and some same-sex spouses may not be eligible for SSI.

As with other Social Security programs, all people who believe they may have a claim to SSI are advised to apply for the benefits immediately, because benefits are typically awarded retroactively to the date of filing.

The Social Security Administration has made several accommodations for same-sex spouses to attempt to comply with the Supreme Court ruling in Windsor.

The agency has already announced that they will pay survivor benefits to the living spouse of a same-sex marriage, and that they will award retirement benefits on the same basis for same-sex as for opposite-sex spouses. Both of these changes are likely to increase benefits for Gay and Lesbian spouses.
