BC denies accreditation to anti-Gay Christian law school

A Christian law school set to open in Vancouver, British Columbia, has lost its accreditation because it discriminates against LGBT students.

In a binding referendum, members of the Law Society of British Columbia voted overwhelmingly to revoke accreditation for Trinity Western University's law program. In all, 74% of the lawyers voting decided to reject the school.

The results were then ratified by the group's Board, by a vote of 25-1, with four abstentions.

The society says the decision means that 'the proposed law school at Trinity Western University is not an approved faculty of law for the purpose of the Law Society's admission program.'

Trinity Western is an independent university founded by the Evangelical Free Church of America, a fundamentalist denomination with roots in Scandinavian immigrant churches. Its students are required to sign a covenant that forbids sexual relations outside of a church sanctioned (and therefore opposite-sex) marriage. Students who violate the covenant may be expelled.

Victoria, BC, lawyer Michael Mulligan, who launched the referendum on the issue, says the school's policy discriminates against people in Gay and Lesbian relationships.

'The policies of this university are inconsistent with core values of legal profession insofar that this university continues to discipline or expel students for their private sexual activities,' Mulligan said.

The BC Law Society has been joined by other Canadian lawyers' groups. The Law Society of Upper Canada in Ontario has voted against approving Trinity Western's law school and the Nova Scotia Barristers' Society voted to grant accreditation only if the school changes the covenant for law students or allows them to opt out.

Trinity Western is legally challenging those decisions in court, arguing they have a right to religious freedom.

TWU president Bob Kuhn expressed his frustration with the recent vote as he left a ratification meeting at the law society on Friday morning.

'They had to choose between the principles upon which they made the initial decision and the popularity of that decision among lawyers in the province,' Kuhn said. 'We're disappointed of course they chose the latter. But that's the reality of people in an elected position.'

Kuhn added that it is now unclear whether the law school will move ahead with its 2016 opening date.
