HRC: Supreme Court upholds lower court ruling affirming Trans students

WASHINGTON, DC (May 28, 2019) - Today, the Human Rights Campaign (HRC), the nation's largest lesbian, gay, bisexual, transgender, and queer (LGBTQ) civil rights organization, responded to news that the Supreme Court has declined to hear an appeal from the Alliance for Defending Freedom (ADF) over a 3rd Circuit ruling in Doe v. Boyertown Area School District, meaning that students in that school district will be permitted to use bathrooms and locker rooms that align with their gender identities.

'This is a critical victory for transgender students throughout the United States,' said Robin Maril, HRC Associate Legal Director. 'Again and again, federal courts have affirmed the right of students to use facilities that align with their gender identity, and this latest decision by the Supreme Court to reject an appeal to overturn Boyertown's policy affirms that pattern of equality under the law for all students, regardless of gender identity. The fight is far from over, and from the ballot box to the courts, we will never stop advocating on behalf of transgender and nonbinary students.'

The Supreme Court declined to hear an appeal from the Alliance Defending Freedom (ADF) over a ruling by the US 3rd Circuit Court of Appeals that upheld Boyertown Area Schools' policy allowing students to use restrooms and locker rooms that align with their gender identity.

The Human Rights Campaign will continue to fight alongside coalition partners [to ensure that] transgender students are treated with dignity and respect in their school environments.
