Washington, DC: Civil rights groups continue suing over Trump-era ACA rule
Philadelphia Gay News reported on August 25 that a federal court has decided to allow the Boston Alliance of LGBTQ+ Youth and others to continue pursuing claims against the U.S. Department of Health and Human Services (HHS), for a Trump-era rule that weakened non-discrimination protections in the Affordable Care Act. While the lawsuit was at first limited to violations the Administrative Procedure Act, and of the Equal Protections clause of the 14th Amendment, it now goes beyond LGBTQ patients to address the harm the rule could do to immigrants, Indigenous peoples, people with chronic illnesses, and more. One plaintiff said that, while the HHS had already somewhat addressed the rule since 2020, the organization hadn't done nearly enough.
Virginia: School board will pay trans student $1.3 million
NBC News reported on August 28 that the Gloucester County School Board in Virginia will pay Gavin Grimm, a transgender student, $1.3 million after five years in a discrimination lawsuit. Grimm sued the board on the grounds of Title IX protections against sex discrimination, after the board overruled his own principal's decision to allow him to use the boys' restroom at school. Grimm faulted the board for its wasteful use of taxpayer money in a statement with the ACLU. Last year, he was elected to the ACLU's Board of Directors.
